PERSONNEL POLICIES 2018- SECTION 1 GENERAL POLICIES
1. PAY CYCLE AND TIME CARD
The pay cycle is Wednesday through Tuesday. Employees must be submitted and corrected by 9 a.m. on each Wednesday. The direct deposit will be deposited on or before Friday (depending on your bank and any pending bank closures). All time cards must be validated by geo tracking or must be logged on a Daily Time Log. Copies of this form are available upon request. (See Section 2 and refer to the GPS Tracking Policy).
LUNCH: Employees are required to take a 30 minute lunch or break during the day. A minimum deduction of 30 minutes is automatic for hourly employees.
2. PROPRIETY DATA
While you are employed at Equipment Solutions, you will not engage in any other employment, consulting or other business activity (whether full time or part time) that would create a conflict of interest with the company.
The undersigned Employee hereby agrees not use or share any proprietary databases or material with companies that compete with the business of EQUIPMENT SOLUTIONS(Company) and its successors.The Employee acknowledges that ES may, in reliance of this agreement, provide access to trade secrets, customers and other confidential data and good will. The Employee agrees to retain said information as confidential and not to use said information on his or her own behalf or disclose same to any third party. The Employee also agrees to take reasonable security measures to prevent accidental disclosure. This agreement shall be binding upon and inure to the benefit of the parties, their successors, assigns, and personal representatives.
3. EMPLOYEE/EMPLOYER RELATIONSHIP
Your employment with the ES will be “at will,” meaning that either you or ES may terminate your employment at any time and for any reason, with or without cause. Although your job duties, title, compensation and benefits, as well as the company’s personnel policies and procedures, may change from time to time, the “at will” nature of your employment may only be changed in an express written agreement signed by you and a duly authorized officer of the company (other than you).By signing this contract, the employee agrees to the terms herein. The right to terminate employment or this agreement of any employee for just cause at any time without notice and without payment in lieu of notice. Equipment Solutions is entitled to terminate your employment upon providing to you such minimum notice as required by law.
4. HEALTH INSURANCE
Equipment Solutions will pay 100 percent of your individual health care coverage up to $400 monthly. If the monthly installment exceeds this cap, the difference will be deducted from your paycheck. This benefit subject to change at anytime based on the healthcare fluctuation. In addition, you will be entitled to paid vacation, sick and holidays in accordance with the Company’s policy. **** INSURANCE WILL GO INTO EFFECT 90 DAYS AFTER START DATE Employees must fill out the health insurance form to initiate Health Insurance. Employees must work 40 hours per week to be eligible for paid health insurance. If an employee works less than 40 hours for two consecutive weeks, the employee full time status and associated benefits will be terminated.
5. VACATION AND TIME OFF POLICY:
Equipment Solutions allows 3 days for personal time off (PTO) and this will be added to the employees vacation annually. Employees must use PTO days or vacation for all absences. Employees must provide a doctor's note or Court note to receive an excused absence, if they cannot present the note they have 2 options: 1). Use a vacation day 2) Receive a “write up” for an unexcused absence. Once the allotted PTO and vacation days are used, subsequent days off will be unpaid. Employees must call in any absence by 8:30 A.M. to a supervisor. If an employee does not call in before 8:30, this is considered no call, no show. A no call no show is subject to disciplinary action. After two “no call no show” disciplinary actions, the employee is subject to termination.
5a) Employees must send vacation requests to office@equipmentsolutionstx.com and must receive approval. This request must be sent 14 days in advance of the requested vacation days. No exceptions.
5b) Vacation and PTO days are eligible to employees working at least 40 hours per week.
5c) Personal time cannot be combined with vacation time without manager approval.
5d) Personal and Vacation days are reset yearly for all employees that have a new start date after July 1st.
5e) Employees that have worked with Equipment Solutions for one year or more, must use all PTO and vacations days within one year they will not carry over to a new year.
5f) If an employee starts after July 1st, Vacation and PTO will not reset on January 1st, it will reset in one year from the start date. After the second year of employment, the Vacation and PTO benefits will reset on January 1st annually.

PTO, VACATION AND HOLIDAY ALLOWANCE
PTO
Employees will receive 3 days of PTO (PAID TIME OFF) this includes sick days and personal time off.
VACATION ACCRUAL
Vacation Allowance Accrual In order to receive the vacation accrual benefit, the tenure must be consecutive years. For example: If you quit, are terminated and are rehired. Your start date begins at your most recent rehire date.
Vacation leave is accrued based on the length of service at Equipment Solutions.
1-5 YEARS OF EMPLOYMENT:
5 days of vacation leave 3 days of personal time
5-10 YEARS OF EMPLOYMENT:
10 days of vacation leave 3 days of personal time
AFTER 10 YEARS:
IF you have been at ES 10+ years an additional vacation day will be added per year. Example: 15 years= 15
PAID HOLIDAYS
Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving TH/FRI, Christmas, Christmas Eve, New Year's Day
6. EMPLOYEE EXPECTATIONS
6a. A professional attitude is to be displayed at all times with co- workers and customers. A professional attitude is also reflected in an employees appearance when representing Equipment Solutions.
6b. Employees are expected to report to work organized and on time with the goal of producing high quality work quickly in the most efficient way possible.
6c. Express interest, ask questions and volunteer to make yourself a viable part of the team.
6d. Employees are provided with electronic devices and software tools to do their job. It is the responsibility of each employee to utilize these tools. If additional resources are needed or training is necessary, it is the responsibility of the employee to notify management. 6e. Time cards must be filled out in the field service application and this must be done no later than Wednesday at 9 a.m. If you make a mistake or need an adjustment, please notify the office by sending a message, noting the error in the time card or make a phone call before 9 a.m.. each Wednesday.
6f. As an employee of ES, your objective is to treat everyone you deal with cordially and with respect, and to give each customer excellent service.If you need more training or additional resources are needed to do your job in the most efficient way possible, it is your responsibility to know the systems in place. le, it is your responsibility to know the systems in place.
6g. All service trucks, trailers and tools must be maintained and treated with respect. This includes ensuring that routine maintenance is done, the inspections are current and keeping the vehicles, tools and trailers clean.
6h. If an employee is injured on the job, they must notify management immediately. Injuries for pre-existing conditions are not considered work related injuries.
6i. Create a positive work environment. If an employee has suggestions or issues with the existing processes, please contact management with suggestions and examples of the issues. Equipment Solutions is a Solution oriented environment.
6j. Our employees are advised to use our company’s internet connection for the following reasons: 1) To complete their job duties. 2) To seek out information that they can use to improve their work. 3) We expect our employees to exercise good judgement and remain productive at work while using the internet. Any use of our network and connection must follow our confidentiality and data protection policy. Employees should: A) Keep their passwords secret at all times. B) Log into their corporate accounts only from safe devices. C) Use strong passwords to log into work-related websites and services. D) Our employees mustn’t use our network to: 1) Download or upload obscene, offensive or illegal material. Send confidential information to unauthorized recipients. 2) Invade another person’s privacy and sensitive information. 3)Download or upload movies, music and other copyrighted material and software. 4) Visit potentially dangerous websites that can compromise the safety of our network and computers. 5) Perform unauthorized or illegal actions, like hacking, fraud, buying/selling illegal goods and more. 6) We also advise our employees to be careful when downloading and opening/executing files and software. Our company may install anti-virus and disk encryption software on our company computers. Employees may not deactivate or configure settings and firewalls without managerial approval. We won’t assume any responsibility if employee devices are infected by malicious software, or if their personal data are compromised as a result of inappropriate employee use.
7. DISCIPLINARY ACTIONS
A. VERBAL WARNING: Oral warnings are designated for minor first offenses.
B. WRITTEN WARNING: After an employee has received an oral warning, a subsequent offense will be addressed by a written reprimand as appropriate. The written reprimand will be given to the employee directly following the discussion. It will be signed the copies will reside in the employee's official personnel file.
C. TERMINATION:. The following are reasons for immediate termination
-If an employee receives three written warnings, termination is iminent.
-No call, no show for 48 hours.
-Insubordination
-Employee disregards the safety manual.
-If an employee is under the influence of drugs or alcohol on the job it is grounds for immediate termination.
-Time Theft: Inflating time card, adding time that was not worked, submitting incorrect hours knowlingly.
-Failure to follow terms of Section 2 GPS and Company Vehicle Policy
- Equipment Solutions reserves the right to terminate an employee at will for other serious offenses at the discretion of the supervisor. Termination of employment is a result of a serious offenses, past records and write ups and any new circumstances.
EMPLOYEE: By signing this employee handbook, I have read and agree to the above terms. The terms of these policies will change yearly and may be amended at any time and will be communicated as necessary.
