Liability Release & Agreement:

I wish to participate in an Opperman Photographics, Inc ("OPI") guided trip as specified above (the “Trip”), which may include in-the-classroom and outdoor field experiences. I understand that there are possible dangers associated with the Trip which can be the cause of loss or damage to my equipment, accidental injury or illness, or in extreme cases, permanent trauma or death. OPI does not want to frighten me or reduce my enthusiasm for this Trip, but believes it is important for me to know in advance what to expect and to be informed of the inherent risks including, but not limited to, slips and falls while walking on poorly lit, uneven, and/or slippery terrain; exposure to allergenic plants, stinging insects, and/or disease (including, but not limited to Covid-19); close proximity to potentially dangerous animals; war, terrorism and/or political unrest; severe weather or other forces of nature; as well as transportation accidents. Given the unpredictable nature of travel, weather, and wildlife, OPI reserves the right to modify, without prior notice, the itinerary, accommodations, and guide(s) as it deems necessary and shall not be held responsible for delays or interruptions, mechanical breakdowns, loss or theft of property, and/or illness or injury. In the event of a personal injury or illness, I hereby authorize OPI and its guide(s) to consent to emergency medical care on my behalf. I understand and agree I shall be solely responsible for any and all costs and expenses for or related to such medical care. I acknowledge that engaging in this Trip may require a degree of skill and knowledge different from other activities and that I have responsibilities as a participant. I acknowledge that the staff of OPI has been available to more fully explain to me the nature and physical demands of this Trip. I certify that I am fully capable of participating in this Trip. I agree to strictly comply with all local laws, respect local customs and culture, adequately assess my abilities, respect other participants’ privacy, and follow the instructions and advice of the guide(s). OPI or the local operator or guide(s) have the right to remove anyone who we a) judge to be incapable of meeting the rigors and requirements of participating in the trip activities; or b) determine to detract from others’ enjoyment of the trip. I agree that I am voluntarily participating in the Trip at my own risk, and acknowledge that OPI has made no warranty or representation, expressed or implied, regarding the safety of conducting the Trip.

I understand and agree to the following CANCELLATION POLICY: Deposits are non-refundable. Any amounts paid above the deposit will be refunded as long as you cancel your reservation before the final payment deadline of the Trip. After the final payment deadline, NO REFUNDS WILL BE GIVEN. If you are able to find someone to take your place, OPI will allow substitutions as long as there is adequate time to make necessary reservation changes and the substitute is capable of participating in the Trip. You are solely responsible for finding a substitute and substitutions will be approved or denied in OPI's sole discression. A $1000 substitution fee will be charged and additional fees may apply for substitution on trips with internal flights or other name specific reservations. OPI also reserves the right to cancel for any reason (such as due to the lack of minimum attendance requirements). In the event OPI cancels the Trip before departure, you will receive a full refund including your deposit; however, OPI shall not be liable for any other expense you may incur due to such cancellation (such as flights, visas, travel or any other expenses incurred in preparation for the Trip). Terrorism, pandemics, government travel restrictions, bad weather and other similar types of events that make the trip too difficult, dangerous, and/or impossible to run are NOT considered a cancellation by OPI. No refunds will be provided for any unused portion of the Trip once the Trip begins including if you leave the Trip for any reason or have to be removed from the Trip. We therefore strongly encourage participants to purchase comprehensive and adequate travel and evacuation insurance. Participants who choose not to purchase insurance or purchase inadequate insurance do so at their own risk.

I assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. I agree I am solely responsible for any adverse consequences resulting from incomplete or defective documentation. While OPI may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, OPI is not responsible for any errors or omissions in the information provided.

Unexpected price changes are rare, however, OPI reserves the right to charge additional fees as necessary to cover unavoidable cost increases that occur between the time we set Trip prices and the end of the Trip, such as, but not limited to, higher fuel prices, increased fees, and/or currency exchange rate increases. I agree to and will pay for any such price increases upon notification of the price increase.

To help you get the most out of your Trip, OPI may provide you with its copyrighted instructional materials such as handouts, video files, practice images etc, solely for your personal use and study. I agree to protect such materials and shall NOT copy, publish, or share such materials, in whole or in part, without the express written consent of OPI. Additionally, during the Trip we may visit sensitive ecological areas that would be negatively impacted by large numbers of visitors. I agree to follow all rules and guidelines at each site and will NOT disclose or publish, in perpetuity, the names or location information for any areas we list as sensitive.

I also hereby grant permission to OPI to use my name and reproduce my appearance, likeness, and voice in connection with the Trip in any and all manners, including promotional materials, and any and all media, including the Internet and social media, throughout the world and in perpetuity.

I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, and hereby release, waive, and indemnify OPI, its officers, directors, employees, volunteers, agents, licensees, partners, sponsors, contractors, successors, and assigns from any and all liability, claims, demands, losses (including all related expenses), or causes of action to which I have or may have for (i) libel, defamation, invasion of privacy or right of publicity arising from OPI’s use of my appearance, name, likeness, voice and biographical information, including but not limited to, the distribution, broadcast or exhibition thereof or (ii) any loss, damage, or injury to person or property suffered or incurred by me in connection with any aspect of my participation in the Trip. I have carefully read, clearly understood, and accept the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon me, my heirs, assigns, personal representative, and estate and for all members of my family, including minor children. By signing below, I certify I am of legal age or authorized to sign on a minor's behalf, and agree to all of the foregoing terms with the same force and effect as if I had signed this Release and Agreement by hand:
