2. Rates and Payments:
In consideration for use of the above details, the Lessee agrees herein to pay LVST an hourly rate of: <br><br>Full Main Turf (approx. 4,000 sqft) <br><br>**Pricing M-F | 5pm-10pm + Weekend Hours**<br><br>-Small group turf rentals <br>8 participants and under<br>$120/hr<br><br>-Medium group turf rentals <br>9-15 participants <br>$150/hr<br><br>-Large group turf rentals <br>16 participants and over<br>$180/hr<br><br>**Special rates**<br>M-F | 4-5pm /4:30-5:30pm<br>$60/hr<br><br>Individual Training <br>M-F + Weekends (limited availability) <br>$60/hr<br><br>**Teams/clubs will be required to provide proof of insurance. <br><br>**For long term/multiple hour turf rentals payments will be made in three increments. 1/3 of total amount for a deposit to hold the space, 1/3 of total amount before first training date, and 1/3 of total amount by the halfway point of the total dates being used. 100% of invoice balance over 3 payments. If you are unsure of the group size we require a deposit at the beginning of the month and tally up and provide an invoice accordingly minus the deposit at the end of the month. <br><br>**For one time use of turf rentals an invoice will be sent via email and payment will be required the week prior of the turf rental date use. If payment is not made at least 72hrs prior to your turf rental date your time slot will be forfeited.<br><br>Thank you!
3. Insurance:
Does not apply to individual rental.
Club/Team Lessee has, and shall maintain throughout the term of this Agreement, general liability insurance, naming LVST as an “additional insured,” in an amount of coverage not less than $1,000,000 per occurrence, including personal injury and property damage. Prior to the use of the Property, Lessee agrees to deliver to LVST a certificate of insurance by an insurance company satisfactory to LVST, which names LVST as an additional insured and provides that the insurance company must provide the LVST with at least ten (10) days prior written notice of any cancellation or reduction in coverage. If you do not have insurance and would like to utilize LVST insurance, you will have to have each player participating sign a waiver before your first event.
4. Indemnification:
The Lessee assumes and agrees to be fully and exclusively responsible for the safety of the persons and property of all participants in the events during the Rental Period, including, without limitation, employees, participants, associates, guests, spectators and any members of the public in attendance at any of the events being held by the Lessee at the facility. The Lessee shall defend, indemnify, and hold the LVST, its officers, employees, and agents harmless from and against any and all liability, loss, expense, including reasonable attorneys’ fees, or claims for injury or damages arising out of the performance of this Agreement but only in proportion to and to the extent such liability, loss, expense, attorneys’ fees, or claims for injury or damages are caused by or result from the negligent or intentional acts or omissions of the Lessee, its officers, agents, employees, participants, associates, guests, spectators and any members of the public in attendance at any of the events being held by the Lessee at the facility.
5. Damage/Cleaning:
Lessee agrees to be responsible for and, if necessary, to reimburse LVST for any damages caused by any person employed or hired by the Lessee, including any guests. Rental Lessee is responsible for putting away any LVST equipment they utilize during their session.
6. Facility:
Lessee herein acknowledges that access to the LVST facility for this rental is limited to the Turf Field during the times and dates listed above. During these times, the Lessee herein acknowledges that LVST will continue it's normal operation, including but not limited to use of any and all facilities not otherwise contained within the scope of this Agreement. This Lease is not, nor will it be interpreted to be a grant of exclusive use or occupancy of LVST.<br><br>Following the use of the facility as identified above, the Lessee shall be solely responsible for returning the rented space to the same condition as they were prior to the rental. Should the Lessee fail to return the facilities to an appropriate condition, Lessee herein agrees to an additional charge of $50 per hour required to clean the space. And invoice for such cleaning will be generated and forwarded to the Lessee as required.
7. Default:
In the event that the Lessee violates any of the terms or conditions contained within this Lease Agreement, it is within the sole and exclusive discretion of LVST to declare a default. In the case of a default, LVST has the right to immediately terminate the rental terms of this agreement, immediately demand the Lessee vacate the property and declare that any and all monies paid by the Lessee are forfeited. Should the events leading to the default require additional time or expense to correct or otherwise return to normal condition, the Lessee agree to be solely responsible for said costs or expenses upon the submission of an invoice for such services or expenses.
8. Entire Agreement:
This Lease Agreement contains the entire agreement between LVST and Lessee. Any and all terms and conditions of the rental agreement are contained herein and no oral modification of the terms of this Agreement are permitted.
Refund Policy:
1. Reservation and Cancellation:<br><br>All turf rental reservations are subject to availability and must be confirmed through our booking system or with our program and marketing director/facility manager.<br><br>Cancellations made at least 30 days in advance of the scheduled rental date will be eligible for a full refund.<br><br>Cancellations made within 14 days of the scheduled rental date may be subject to a cancellation fee, partial refund or credit for another date.<br><br>2. Weather-Related Cancellations:<br><br>In the event of inclement weather (e.g., heavy rain, snowstorms), we prioritize the safety of our customers and reserve the right to cancel or reschedule turf rentals.<br>Weather-related cancellations initiated by us will result in a full refund or the option to reschedule.<br><br>3. Facility Closure:<br><br>If our facility is closed due to unforeseen circumstances (e.g., maintenance, emergencies), and it affects your scheduled turf rental, you will be eligible for a full refund or the option to reschedule.<br><br>4. Customer Initiated Changes:<br><br>Changes to the reservation date or time are subject to availability and must be requested in advance. Refunds or adjustments for customer-initiated changes will be determined on a case-by-case basis.<br><br>5. No-Show Policy:<br><br>Failure to show up for a scheduled turf rental without prior notice may result in the forfeiture of the rental fee, and no refund will be issued.<br><br>6.
