The International SeaKeepers Society Virginia Key Beach Cleanup Waiver of Liability
PERMISSION TO PARTICIPATE
I hereby affirm that I, (the "Participant"), have permission to participate in the Beach and Waterway Clean-up (the "Activity") to remove marine debris from Virginia Key Beach. I understand that this Activity involves collecting and removing trash and marine debris from Virginia Key Beach and/or the waterways around the area via kayak. I accept full responsibility for all medical expenses for any injuries that might occur to the Participant by reason of his/her participation.
COVID-19
MY UNDERSTANDING. I understand that by leaving my home, I am exposing myself to a greater risk of becoming infected with coronavirus, or of infecting other people.<br><br>MY PROMISE In order to do my part to not spread this deadly virus, I agree to not participate in the Activity and to return home if (a) I have symptoms of COVID-19 or (b) there is reason to believe I carry the coronavirus despite the current absence of symptoms. If I participate in the Activity, I agree to strictly follow all health and safety rules and guidelines listed in the procedural guidelines for this Activity.
RELEASE OF LIABILITY
By signing this RELEASE OF LIABILITY, however, I hereby release the International SeaKeepers Society, its Board of Directors, members, agents, sponsors, employees, staff, researchers and volunteers, as well as the owners of the launch site premises and any other parties who might be claimed to be liable, whether or not herein named (the "Released Parties") from and against any and all claims, demands,damages, actions, causes of action, complaints, suits of any kind or nature whatsoever or other forms of liability that any of them may sustain, including but not limited to injury, death or any other damages that may occur or develop in the future (the "Released Claims") to the Participant of the Participant's family, heirs, or assigns that may occur as a result of the Participant's participation in the Activity or as a result of the negligence of any party, including the Released Parties, whether passive or active. I also agree to indemnify and hold harmless the Released Parties from the Released Claims, including any and all related costs, attorney fees, liabilities settlements, and/or judgments.
CONFIRMATION
I confirm that I have carefully read this RELEASE OF LIABILITY and agree to its terms knowingly and voluntarily, I acknowledge that I understand that this RELEASE OF LIABILITY shall be binding upon the undersigned and his/her respective heirs, executors, administrators, personal representatives, successors and assigns. I also confirm that I am the parent or legal guardian of the Participant or I am the above named Participant and I am 18 years or older as of the date signed below.
