This Personal Property Storage Agreement ("Agreement") is between you ("You" or "your") and Servendez Corporation ("Store Your Dorm", "we", "our", or "us"). Store Your Dorm provides the moving and storage of your personal property from your designated address to our storage location, with return delivery in accordance with this Agreement. Please read the following terms carefully:

1. Payment Policy

Your invoice will be made available online, and it is your responsibility to review it carefully before making payment.

Invoice Discrepancies: If there is any error or discrepancy on your invoice, you must notify us prior to making the payment. Once payment is made, we will consider the invoice as accepted, and no further adjustments will be made.
Payment Denial: All invoices must be paid before re-delivery, and after receiving it. Failure to pay your invoice for services rendered within the agreed-upon period will result in additional charges. Unpaid invoices may be sent to a third-party collection agency, and you will be responsible for any collection fees incurred. Additionally, any negative impact on your credit score resulting from non-payment and collection efforts will not be Store Your Dorm’s responsibility. By utilizing our services, you acknowledge and accept that your account may be sent to a debt collection agency in the event of non-payment. Store Your Dorm reserves the right to refuse for a redelivery until the invoice is paid in full.

Invoice Calculation:
The total invoice is based on the number and type of items you wish to store with us, using the pricing chart available on storeyourdorm.ca
Standard rates are as follows, pricing is per month:
Small items: $8; Medium items: $12; Large items: $16; Extra-large items: $20; Bulky items: $35. For items that do not fit within our standard box sizes (e.g., miscellaneous items like furniture), we will determine the cost based on the closest matching size from our pricing chart.

Storage fees are calculated based on full calendar months. The storage period begins in the month of pick-up and continues until the month of re-delivery. For example, if your items are picked up on April re-delivered on September, this will be considered as five months of storage, as we count the entire month of both April and September. We do not pro-rate based on partial months; any portion of a month is billed as a full month.

2. Cancellation Policy

We understand that plans can change. To avoid cancellation fees, please provide us with a minimum of 12 hours’ notice before your scheduled drop-off or pick-up. Cancellations made after this period will incur a fee of $100 for Toronto, Ottawa, and Montreal, or $120 for Kingston, Manitoba, and Vancouver. This fee covers the costs of transportation, labor, and processing.

3. Rescheduling Policy

If you need to reschedule, please notify us at least 24 hours in advance. A $50 fee applies for rescheduling requests made within 24 hours of the scheduled appointment to cover administrative costs.

Missed Redelivery: Regardless of whether the delay or missed redelivery was the responsibility of Store Your Dorm or beyond our control, it is the customer’s responsibility to promptly contact us to arrange an alternate redelivery date. We will work with you to reschedule at the earliest available time, but please note that additional fees may apply based on the circumstances of the missed delivery.

4. Missed Appointments

Missed Appointment & Late Arrival Policy: Your time is valuable, and so is ours. If you miss a scheduled appointment without providing prior notice, a $75 fee will be applied to compensate for our team's time and resources. Additionally, if you arrive more than 15 minutes late, a $25 late fee may be charged to maintain the efficiency of our services.

Redelivery Responsibility & Missed Appointment Liability: By scheduling a redelivery with Store Your Dorm, you agree to be present at the designated time and location, even if a delay has been communicated. If you are unavailable to receive your items when the drivers arrive, you assume full responsibility for any consequences that arise from the missed redelivery. This includes, but is not limited to, the risk of theft, loss, damage, misallocation, or other incidents that may occur during or after the attempted delivery.

Limited Liability for Missed Redelivery: Store Your Dorm will not be liable for any loss or damage to your belongings if you are not present for a scheduled redelivery. Any subsequent redelivery attempts will be subject to additional fees. You are solely responsible for ensuring that arrangements are made for the safe and timely receipt of your belongings. By accepting these terms, you acknowledge and agree to release Store Your Dorm from any liability related to missed redelivery appointments.

5. Promotional Offers

To redeem a promotional discount, please ensure that you notify us at the time of booking. For example, reservations made before April 10th are eligible for a 50% discount on the first month of storage, and those made before April 20th receive a 40% discount. These offers are only valid if applied during the booking process.

6. Fragile Item Policy

We take the utmost care in handling your belongings. However, items that are not packed in official Store Your Dorm boxes are not covered under our liability policy.

To qualify for liability coverage:

Items must be packed in Store Your Dorm boxes.
Items must be securely packed and sealed by the customer.
This does not apply to furniture, hardware, glassware, electronics, artwork, ceramics, cookware, and/or antiques.

Our liability policy covers you up to a $100 for your entire order. We highly recommend using our official boxes for delicate or valuable items. If you choose to use your own packing materials, you assume full responsibility for any damage that may occur. Please contact us if you need assistance in selecting the right packing materials.

Damage Claims: If you discover any damage to your belongings that were packed in official Store Your Dorm boxes, you must report the issue to us within 5 days of receiving your items. After this 5-day period, we cannot assume responsibility, as it is possible that external events occurring after delivery could have compromised the condition of your items.

7. Abandoned Items and Non-Payment Policy

Important definition: The final day of the storage period shall be defined as the last calendar day of the month for which payment has been made in full. For instance, if you have paid for five months of storage, and the fifth month is September, your final storage day will be September 30th.

Payment and Communication Requirement:

Customers are required to settle any outstanding invoices prior to the re-delivery of items. Failure to do so may result in storage fees continuing to accrue, and your items will not be returned until the full balance is paid.

Abandonment Period:

If we have not received payment for extension or communication, for a storage order within 100 days from the final day of the storage period, your items will be considered abandoned. Store Your Dorm reserves the right to dispose of or donate your items without further notice or liability.

Store Your Dorm will no longer be liable for any loss, damage, or disposition of your items. By using our services, you acknowledge and agree that Store Your Dorm is not responsible for items deemed abandoned under this policy.

Interest on Late Payments:

In the event that an agreement is made to extend the storage period for your items and the corresponding invoice for extension of storage remains unpaid, the following interest rates will be applied to your total balance, reflecting the extended use of our facilities:

Over 3 months past the storage deadline: A 15% interest charge will be applied.
Over 6 months past the storage deadline: A 17.5% interest charge will be applied.
Over 10 months past the storage deadline: A 20% interest charge will be applied.

These interest charges reflect the additional costs incurred by the company to store your items beyond the agreed period. The charges will be applied to the total order, including any prior services or storage fees.

8. Environmental and Storage Condition Disclaimer

Store Your Dorm provides safe and secure storage, but we cannot control environmental factors such as humidity, moisture, or temperature fluctuations that may affect the condition of your items. As such, we are not liable for damage caused by mold, mildew, moisture, or other similar factors that arise during storage.

Important: Customers are encouraged to purchase insurance for their items if concerned about potential environmental risks. By using our service, you acknowledge this risk and agree that Store Your Dorm is not responsible for such damages.

9. Prohibited Items and Penalties

To ensure the safety and security of all items stored with us, certain items are strictly prohibited from being stored in our facility. The following items are not allowed and must not be included in your storage:

Illegal Items: Any items that are illegal under local, state, or federal laws, including but not limited to drugs, controlled substances, and illegal paraphernalia.
Weapons: Firearms, explosives, and any other types of weapons or ammunition.
Food and Perishables: Both perishable and non-perishable food items are strictly prohibited. Storing food can attract pests and rodents, creating a health hazard and potential damage to other items.
Hazardous Materials: Flammable, explosive, or toxic materials, including but not limited to chemicals, fuels, and cleaning agents.
Valuables and Irreplaceable Items: High-value items such as cash, jewelry, and important documents should not be stored. While we offer storage solutions, we recommend using specialized services for high-value or irreplaceable items.
Live Animals and Plants: Animals or plants of any kind are not permitted, as they require specific care and conditions that are not available in our storage facilities.

Penalties for Violations:

Violation Charges: Any attempt to store prohibited items will incur an immediate charge of $250. This fee is assessed to cover the costs associated with the removal and proper disposal of the prohibited items and to mitigate any associated risks.
Failure to Pay: If the $250 penalty is not paid within 10 business days of notification, the account will be referred to A&G Group Services® for debt collection. Additionally, a police report may be filed if the situation involves illegal or dangerous items.
Legal and Financial Consequences: In the event of non-payment, Store Your Dorm reserves the right to seek recovery of the outstanding amount through legal channels. Any legal fees or additional costs incurred will be the responsibility of the customer. Furthermore, any violation involving illegal items may result in criminal charges and legal action.
Insurance and Liability: Store Your Dorm is not liable for any damage or loss caused by the presence of prohibited items. If such items are discovered, they will be immediately removed from the premises, and the responsible party will be charged for any damages or additional costs incurred.

We take these measures to ensure a safe and secure environment for all stored items. By using our services, you acknowledge and agree to comply with these prohibitions and understand the consequences of violating this policy.

10. Moving Fees

We aim to make your move as simple as possible. Our standard moving fee is $140, which covers:

Box Drop-Off (Free)
Box Pick-Up ($70 value)
Re-Delivery ($70 value)

If additional services are required:

Extra Pick-Up: $60 for each additional trip.
Additional Re-Deliveries: $60 for each extra re-delivery.
Time Window and Compensation Although we provide all clients with a 2-hour time window for moving services, we reserve the right to be up to 96 hours outside of this time window due to unforeseen circumstances. These circumstances may include, but are not limited to, technical issues with transportation, employees cancellations, driver no-shows, troubel at warehouse, among others.
If there is a delay extending beyond the 96-hour window, a compensation of $40 will be provided to the affected customer.

11. Redelivery Policy

We provide complimentary redelivery within the same city where your items were originally picked up. If redelivery is requested outside the original location, additional fees apply based on distance.

Free Redelivery Locations:

Toronto, Montreal, Ottawa, Vancouver

Paid Redelivery Fees:

$60 per 100 km outside Montreal
$50 per 100 km outside Ottawa
$80 per 100 km outside Toronto
$70 per 100 km outside Vancouver

12. Customer Responsibility

By using Store Your Dorm’s services, you agree to:

Properly pack and secure your items, especially fragile or valuable ones.
Assume responsibility for any damage to items not packed in our official boxes or for items improperly packed.

Any violation of the terms outlined in this agreement, including but not limited to misuse of equipment, damage to property, failure to adhere to packing guidelines (such as our Fragile Item Policy), or disruptive behavior, may result in additional fees or legal action. These fees, assessed on a case-by-case basis, will be communicated to you in writing and reflect the costs incurred due to the breach.

By agreeing to this agreement, you expressly acknowledge that you have read, understood, and accepted all outlined policies, including but not limited to the Fragile Item Policy, Cancellation Policy, and Liability Waivers. You agree that Store Your Dorm is not liable for any damages or losses that occur in adherence to these terms, and you waive any claims against us for such occurrences.

In the event of non-payment, refusal to meet your obligations, or legal disputes arising from the violation of these terms, you consent to the designation of a Debt Collection Agency or legal counsel to recover outstanding amounts or resolve disputes. You further agree that by accepting this agreement, you have voluntarily waived any legal claims that contradict these terms, and you assume full legal and financial responsibility for any breach.

Definitions The defined terms in this Section 1 are used throughout this Agreement and shall have the following meanings. All terms not defined should be defined with logical reasoning and appropriate judgment. "Storage Plan" or "Custom Plan" means the individual storage plans for each specific Property. "Box" or "Boxes" mean the carton or cartons containing your materials to be stored by Store Your Dorm under this Agreement and shall include cartons provided by Store Your Dorm ("Store Your Dorm Box") as well as your own. "Tape" means the packing tape used to seal a Box under this agreement and shall include packing tape provided by Store Your Dorm ("Store Your Dorm Tape") as well as your own. "Store Your Dorm Website" means the Store Your Dorm website located at https://www.storeyourdorm.com as well as any web pages under the domain. "Store Your Dorm Supplies" means any and all packing materials supplied by Store Your Dorm on your behalf under this Agreement and shall include Store Your Dorm Boxes, Store Your Dorm Tape, and any other packing supplies. "Property" means any and all items stored or held by Store Your Dorm on your behalf under this Agreement, including all items contained within a Box and the box itself, individual items not stored within a Box, and boxes and items stored within a Space Plan. "Services" means the services provided by Store Your Dorm under this Agreement, including all box drop-off, pick up, labor and moving, transportation, storage, and delivery services. "Appointment Dates" mean any date where Store Your Dorm will be meeting with You, including but not limited to "Box Drop-Off Dates", "Pickup Dates", or "Delivery Dates". "Start Date" means the date that Store Your Dorm picks up Boxes or other Property from You. "Storage Term" means the storage duration used per billing cycle of 1 month, in respect to the pickup dates ("Pickup Dates") and return dates ("Delivery Dates") listed on our Website. "Box Drop-Off Dates" means the dates when Store Your Dorm Supplies (i.e. Store Your Dorm Boxes) are supplied to You.
