In consideration of the opportunity granted to me by Bendix Commercial Vehicle Systems LLC and Bendix Spicer Foundation Brake LLC (“BENDIX”) allowing me to participate as a passenger, driver or spectator observing a motor vehicle demonstration conducted by BENDIX demonstrating the characteristics of a BENDIX product and/or the operation of a vehicle featuring: Bendix Active & Supportive Safety Technologies, I do hereby, for myself and on behalf of my heirs, executors, administrators, successors, and assigns, completely and unconditionally release and discharge BENDIX and each of its past, present, and future officers, directors, shareholders, members, attorneys, dealers, distributors, suppliers, insurers, indemnitors, agents, servants, representatives, employees, parent and subsidiary corporations, affiliates, partners, predecessors, successors and assigns (collectively “the Releasees”), from any and all past, present and future claims, demands, obligations, actions, causes of action, wrongful death claims, rights, damages, costs, loss of services, loss of comfort and society, expenses and compensation of any nature whatsoever, including all claims for compensatory, exemplary or punitive damages, contribution or indemnification, whether based in negligence, contract, breach of warranty, strict liability or any other legal or equitable theory, which I ever had, now have, or which may hereafter accrue or otherwise be acquired by me and arising from or relating to: (a) the product demonstration, (b) any defect or condition associated with the products demonstrated or vehicles used during such demonstration, (c) any physical conditions associated with the Site, (d) my participation in or observation of the product demonstration, and/or (e) riding in, driving or being present near any motor vehicle at the Site during such product demonstration (collectively “The Voluntarily Assumed and Released Risks”).
This Release and Assumption of Risk Agreement specifically includes any and all known or unknown claims or causes of action against BENDIX and the Releasees for economic losses, personal injury, death or property damage caused to or by me or sustained by me, whether occurring or accruing before, as of, or after the date of this Agreement, and also includes all consequences of any such economic loss, personal injury, death or property damage (whether expected, anticipated, unexpected or unanticipated), resulting from or which may in the future result from one or more of The Voluntarily Assumed and Released Risks.
I knowingly and voluntarily acknowledge and personally assume all risks attendant to (a) the product demonstration, (b) any defect or condition associated with the products demonstrated or vehicles used during such demonstration, (c) any physical conditions associated with the Site, (d) my participation in or observation of the product demonstration, and/or (e) riding in, driving or being present near any motor vehicle at the Site during such product demonstration. I further warrant and represent to BENDIX that I know of no physical or mental defect, medical condition or physical limitations or restrictions that would prevent, hinder or otherwise make me susceptible to injury while participating in or observing the product demonstration or while riding in, driving or being present near any motor vehicle at the Site during the product demonstration.
I voluntarily acknowledge and permit BENDIX and its duly authorized agents or assigns to use on a non-exclusive basis, my name, likeness, images, sounds and/or performance as recorded, photographed, videotaped or otherwise preserved, digitally or otherwise, while participating in or observing such product demonstration, and I do hereby relinquish to BENDIX in perpetuity all rights thereto for such purposes
