Boarding Agreement
This agreement is made and effective the date set forth below by and between SPRING RUN STABLES, INC. located at 10200 Covered Bridge Road, Prospect, KY 40059 (hereinafter referred to as Stable/Owner) and the following (hereinafter referred to as Horse/Owner)

THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1.
Stable Owner shall board, keep the horse in a stall unless field board is designated.
The assignment of the particular stall is solely at the discretion of the Stable Owner, although the client’s preference will be taken into consideration.
2. Stable/Owner shall board, keep, feed, water and care for the horse in a good and humane manner. However, the Stable/Owner may vary the diet on account of feed shortages beyond Stable/Owner’s control, or for medical or other such reasons and shall inform Horse/Owner of said variation within a reasonable period of time.
3. Pastured horses will be charged an additional $20.00 per day, per horse, when being stalled.
4. If Horse/owner is unavailable to assist the farrier or vet, a fee of $20.00 will be charged per horse held.
5. Medication/Supplements: Any oral medication or nutritional supplements provided by Stable/Owner will be billed at cost. Supplements provided by owner must be in labeled in individual horse supplement box. If there isn’t a supplement box on your stall that was left by a previous boarder please call Susan at (502) 643-2364. If medication is needed, owner must fill out a medication card, which will go on the horse’s door and a copy is to be on the board in the feed-room. Special medications / schedules are subject to additional fees.
6. The fee for Basic Full Board fee will be $785.00 per month, due each month in advance, Basic Field Board (if available) will be $550.00 per month due in advance, due on the 1st of each month (
whether or not Horse/Owner receives a statement
) and becomes late on the 15th. A late payment fee of $25.00 will be charged. Late payment is determined by postmark. All payments are to be sent to Spring Run Stables, Inc., P.O. Box 629, Prospect KY 40059. Returned checks will be treated as non-payment and an additional $25.00 fee will be charged.
7. A thirty-day notice to terminate this agreement will be required. If horse is removed before this thirty days notice, Horse/Owner will be charged for the remaining days.
8. Horse/Owner will be required, and agrees to, provide immunizations on a periodic basis as will be specified by the Stable/Owner and its D.V.M. advisor.
9. On Horse/Owner’s failure to make timely payment to Stable/Owner for services rendered, Stable/Owner shall be entitled to a lien against the horse. In all proceedings to satisfy said lien, the lien may be deemed to have been acquired, and publication of notice of such sale may be made in any newspaper of general circulation in the Louisville, Kentucky area. Horse/Owner shall be deemed the owner at the time of sale, unless the transferee shall have notified Stable/Owner in writing of such transfer and his address, in which case, said transferee shall be deemed to be the person on whose account the horse is held.
10. Except for its failure to maintain and care for the horse in a good and humane manner, Stable/Owner shall not be responsible for any loss or damage to the horse arising out of Stable/Owner’s maintenance, boarding, and care of the horse and Horse/Owner shall not hold Stable/Owner, its agents, representatives and employees liable for any loss, injury or damage to the horse or any other property of the Horse/Owner now or hereafter causing into the possession or control or Stable/Owner or its agents.
11. Horse/Owner shall indemnify Stable/Owner, its agents, employees, lessor and representatives against and hold them harmless from any and all claims, demands, liabilities, actions, suits and proceedings of every kind, including the costs and expenses thereof, arising out of Horse/Owner’s use and enjoyment of the horse, including, without limitation, the use and enjoyment of horse by the Horse/Owner’s guests, agents and permitees.
12. Horse/Owner shall abide by all the rules and regulations of Spring Run Stables, Inc., whether now in effect or later adopted, and shall comply with all laws, ordinances and governmental regulations.
13. Horse/Owner warrants and represents on the effective date hereof, that the horse is in good health, free from exposure to contagious or infectious diseases and in good condition, has no unusual habits or medical problems other than those, if any, expressly supplied by Horse/Owner to Stable/Owner in writing. Horse/Owner agrees to immediately notify Stable/Owner of any health problems, illnesses or accidents of which Horse/Owner becomes aware during or incident to Horse/Owner’s use of the horse, especially such exposure as above. Horse/Owner warrants that he or she is the sole owner of the horse.
14. Should the horse require the services of a veterinarian, Stable/Owner will contact Horse/Owner for instructions as soon as reasonably practicable. If the Horse/Owner cannot be reached, Stable/Owner is hereby authorized, as special agent for the Horse/Owner, a) to call my veterinarian on file and should said veterinarian be unavailable, b) to contact any licensed veterinarian of Stable/Owner’s choice. All medical charges and fees so incurred shall be the sole exclusive responsibility of Horse/Owner and shall indemnify Stable/Owner against all such needed expenses and fees for the care and treatment of the horse.
15.
An integral part of this boarding agreement is a commitment on the part of each horse/rider combination (where the horse is a Spring Run Boarder) to schedule a minimum of one lesson per week with one of the Spring Run instructors. If you cannot take one or more lessons per week an alternative would be to have your horse schooled by one of the instructors. Should your horse be out of commission for an extended period you are expected to make arrangements for your lessons on a different horse. (In this situation, there will be a one month grace period on this policy.)
16. Invoices for lessons are presented as a convenience for our clients so that checks don’t have to be written for each individual lesson. Monthly invoices for lessons are due immediately upon receipt and will be subject to $25.00 late fee if unpaid by the 25th of the month.
17. Stable/Owner may terminate this Boarding Agreement by providing Horse/Owner a thirty (30) day notice of the termination. Horse/Owner shall arrange to have horse removed from Stable/Owner’s property within this thirty (30) day period.
18. A current Coggins Test Certificate (valid within the last year) and a Certificate of Insurance stating the coverages on your horse must be on file with Spring Run management at all times.
19. Neither Party has any right of control over the affairs of the other nor an ownership interest therein and in no way is this agreement to be considered as creating a partnership relationship or status among them.

Your current board agreement covers basic board at $785 per month.

Spring Run Stables. Inc Transport/Release of Liability Agreement
This Agreement and Release of Liability is made between:
Horse Owner
owner of Horse ("Horse" or "their Horse")
and SPRING RUN STABLES, INC., SUSAN HARRIS PERELLIS, and/or any agent acting on behalf of Spring Run Stables (collectively "Spring Run").
Horse Owner acknowledges they have requested Spring Run to transport their horse to/from veterinary hospital, shows/events and or clinics. Horse owner is aware that Spring Run does not provide transportation insurance for their Horse and it is the Horse Owner’s responsibility to carry insurance. Horse Owner assumes all risks and liabilities associated with the transport of their Horse.
Spring Run will use all ordinary care in the transport of the horse. In the event the Horse requires veterinary services, Spring Run will attempt to notify the Horse Owner, but in the event Spring Run cannot reach the Horse Owner, Spring Run is authorized to call the first available veterinarian of their choice. All fees associated with any veterinary services shall be borne solely by the Horse Owner with no liability on the part of Spring Run.
In consideration for Spring Run providing transport for their Horse, Horse Owner voluntarily releases and forever discharges Spring Run from any and all liabilities, claims, and actions which are related to, or are in any way connected with the transport of their Horse. Horse Owner further agrees and covenants not to sue Spring Run for any injury, death, disease, or damage to their Horse arising from or in connection with the transport, or from any claims asserted by other third parties.
